Terms of Reference (ToR) Consultancy for the Development of a Comprehensive Annual Responsible Mining Audit (RMA) Report

Job Description

1. Background
The Ministry of Mines and Mining Development (MMMD) is implementing the Responsible Mining Audit (RMA). Established in 2023, the RMA provides a framework to assess compliance of mining companies with Zimbabwe’s laws, including mining, environmental, tax, labour, and immigration regulations. Despite progress, gaps remain in aligning the RMA with international standards, ensuring robust methodology, and strengthening stakeholder participation. To address these challenges, MMMD seeks the services of a qualified consultant to produce a Comprehensive Annual RMA Report that consolidates contextual developments, sector-specific trends, compliance risks, and progress on recommendations.

Duties and Responsibilities

2. Purpose of the Assignment
The consultant will develop a Comprehensive Annual RMA Report that:
• captures contextual developments in Zimbabwe’s mining sector with implications for sustainable mining governance.
• analyses compliance trends across the mineral value chain (Mining, Processing, Environment, Social, Legal, Responsible sourcing, and Trade).
• profiles key actors and administrative compliance issues involving MMMD, Environmental Management Agency (EMA), Rural District Councils (RDCs), Ministry of Labour, Zimbabwe Revenue Authority (ZIMRA), and other relevant agencies.
• demonstrates methodological rigour, including RMA framework, audit processes, limitations, key findings, conclusions, and actionable recommendations.
• tracks implementation progress on recommendations from previous RMA cycles.
3. Objectives
The assignment aims to:
1. Produce a high-quality, evidence-based Comprehensive Annual RMA Report aligned with international standards,
distilling sector-specific compliance issues and risks
2. Strengthen transparency and accountability in mining governance by documenting mining sector impact, stakeholder roles and participation.
3. Establish a progress tracker on previous audit recommendations to monitor implementation.
4. Provide practical, risk-informed recommendations for improving compliance, governance, and sustainability in the mining sector.

4. Scope of Work
The consultant will:
1. Review existing RMA data, audit tools, and related reports.
2. Conduct desk-based research on mining sector trends, contextual developments, and international best practices.
3. Hold key informant interviews and consultations with MMMD, EMA, ZIMRA, RDCs, Ministry of Labour, and other stakeholders.
4. Analyse sectoral compliance and governance risks using a risk-based approach.
5. Develop a comprehensive, well-structured report that includes:
• Contextual overview of the mining sector
• Mineral-sector-specific compliance and risk profiles
• Actor mapping and institutional roles
• Detailed methodology, findings, and limitations
• Conclusions and actionable recommendations
• A progress tracker for previous audit recommendations
5. Deliverables
1. Inception Report - outlining methodology, work plan, and data sources.
2. Draft Comprehensive RMA Report - submitted for stakeholder review.
3. Validation Workshop - present findings to MMMD, stakeholders, and technical partners.
4. Final Comprehensive RMA Report - incorporating feedback, professionally edited and formatted.
6. Duration and Level of Effort
The consultancy is expected to run for a month, with key deliverables aligned to RMA reporting timelines.

Qualifications and Experience

Required Qualifications
1. Advanced degree in Mining Engineering, Environmental Management, Natural Resource Governance, or related field.
2. At least 7 years of demonstrated experience in mining governance, compliance auditing, or extractives policy analysis.
3. Strong research, data analysis, and report-writing skills, with proven publications in the extractives sector.
4. Experience working with government ministries, regulators, and civil society on mining sector governance.
5. Knowledge of Zimbabwe’s mining sector, artisanal and small-scale mining dynamics, and international mining audit frameworks.
